By entering into this Agreement, both parties agree to abide by the terms and conditions stated below:
✿ RIGHTS AND USAGE
— The Artist retains all copyrights and ownership of the commissioned artwork.
— The Artist can showcase the artwork in their portfolio and for self-promotion. By agreeing to the commission, the Client accepts these terms.— The Client is allowed to use the artwork for personal display and enjoyment, but cannot reproduce, distribute, modify or use it for commercial purposes.
— The Client is not allowed to sell the artwork.
— The Client is not allowed to use the commissioned artwork and sell it as NFT.
— The Client is not allowed to use the commissioned work in training any AI (artificial intelligence) or ML (machine learning models).✿ PAYMENT
To initiate the commission, the Client must make a payment of at least 50% of the total commission cost upfront. Alternatively, the Client may choose to pay the full amount before the commission begins.
Once the artist has notified the client that the commission has started, the client loses the rights to refund.✿ REVISION
After the initial sketch is sent, the Client is entitled to a maximum of 3 major revisions without additional cost. Any further revisions will incur an additional fee of $3 for each revision.
Once the final piece has been sent, no further revisions will be entertained unless the Client is willing to pay an additional fee of $5 for each revision.✿ CANCELLATION OF ORDER
The Artists reserves the right to cancel an order at any time for any reason. The Artist agrees to refund the exact deposit or payment received from the Client for the Commission. The Artist will not be held liable for any further compensation, damages, or losses resulting from the cancellation of the Commission. The Artist, at her discretion, offer an explanation for the cancellation but is not obligated to do so.✿ DISPLAY AND CREDITS
The artist may display the commissioned artwork in their portfolio, website, or social media, unless the client requests otherwise.
The client agrees to credit the artist when sharing the artwork online.✿ INDEMNIFICATION
The Client agrees to indemnify and hold the Artist harmless against any claims or liabilities arising from the Client's use of the commissioned artwork.By proceeding with the commission, both parties agree to these terms and conditions.
payment & delivery
1) Client and Artist agree on the commission's scope, specifications, and price. Terms and conditions, including payment and delivery process, are shared and acknowledged by both parties.
Step 2: Initial Payment2) Client must pay at least 50% of the commission's total cost or either full payment as a non-refundable deposit. Payment is made through the agreed-upon payment method.International Clients — Paypal, Remitly, Ria Money Transfer.Local Clients — GCash, Bank Transfer3) Artist begins creating the artwork based on the agreed specifications.4) Artist shares the initial sketch (watermarked) with the Client for review. Client reviews the sketch and can request up to 3 major revisions without additional cost. Additional fee of $3 / Php. 150 will be added for further revision.5) Once the sketch is approved, Artist proceeds with completing the final artwork. Artist shares the final artwork (waterrmarked and in low resolution) with the Client for review.6) Client reviews the final artwork.
If no response is received within 3 days, the artwork is considered approved. Additional cost of $5 / Php. 250 will be added for further revision/s.7) Client pays the remaining balance of the commission cost.
Payment is made through the agreed-upon payment method.8) Upon receiving final payment, Artist delivers the high-resolution digital file (note that there is/are no physical product). No further revisions will be entertained.9) The commission process is considered complete after the final delivery. Ownership and usage rights are as specified in the commission agreement.
